These Terms and Conditions ("Agreement") are entered into by and between NEPA Retirement LLC ("Company," "we," "us," or "our") and the individual or entity accessing our services ("User," "you," or "your"). NEPA Retirement LLC provides professional insurance, Medicare, retirement planning, and related financial services. Our services are designed to assist clients with evaluating insurance options, reviewing coverage needs, providing educational resources, and helping individuals make informed decisions regarding their insurance and retirement planning. While we provide information and guidance in accordance with applicable laws and industry standards, final decisions regarding insurance coverage, enrollment, and financial planning remain the responsibility of the client. No guarantees of specific insurance approvals, policy benefits, financial outcomes, or investment performance are made.
Section 2: Age Requirements and Eligibility
Our services and website are intended solely for individuals who are eighteen (18) years of age or older. By accessing our services, you represent and warrant that you are at least 18 years old and possess the legal authority to enter into this Agreement.
Section 3: SMS and Mobile Messaging Disclosures
By providing your mobile telephone number and affirmatively opting into our messaging program, you provide express written consent to receive recurring SMS and MMS communications from NEPA Retirement LLC. These messages may include appointment reminders, insurance quote updates, Medicare enrollment information, policy service notifications, requested documentation, and educational or promotional communications. Consent to receive automated text messages is completely voluntary and is not a condition of purchasing any insurance product or utilizing our services. Message frequency varies based on user interaction and scheduling, and standard message and data rates may apply from your mobile carrier. Mobile carriers are not liable for delayed or undelivered messages.
Section 4: Opt-Out and Help Procedures
You may revoke your consent to receive SMS communications at any time. To unsubscribe, reply STOP to any text message received from the Company. Upon receipt of a STOP request, you will receive one final confirmation message, and no further automated messages will be sent unless you explicitly re-enroll. Section 5: User Representations and Data Security
Users agree to provide accurate, current, and complete personal and financial information when interacting with our web forms and services. SMS opt-in data and consent are strictly confidential and are used solely for communications directly between you and the Company.
Section 6: Intellectual Property
All content, trademarks, service marks, logos, educational materials, retirement planning resources, insurance information, calculators, and other proprietary resources provided through our platforms are the exclusive property of NEPA Retirement LLC. Users are granted a limited, non-transferable license to access materials for personal or internal use only. No content may be reproduced, redistributed, or exploited for commercial purposes without prior written consent.
Section 7: Limitation of Liability and Disclaimer
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services, including decisions made based on information or recommendations provided through our website or consultations. Section 9: Severability and Modifications
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect. We reserve the right to modify these Terms at any time, and such modifications become effective immediately upon posting.
